1.
All
items will be sold as is, where is.
Auctioneer and seller make no representation or warranty, expressed or
implied, on the items for sale and does further state the items are to be sold
“AS IS, WHERE IS ” WITH NO WARRANTY OR GUARANTEE. The items up for auction are available one day before the
auction for inspection. The purchaser acknowledges that he is relying solely on
his or her inspection, and accepts all responsibility for examining any item
offered for sale. Buyer also acknowledges that Auctioneer has not made any
representations upon which Buyer is relying.
2.
All items purchased must be paid for in full
on the day of the auction. Cash,
cashiers checks, certified checks, money orders will be accepted. Business or Personal checks will be accepted
with proper identification. All Checks
are made payable to Brown’s Auction Company.
3.
Sales
taxes on the sale price are collected upon payment. Dealer’s sales tax exemptions will be recognized only upon
providing a proper, current resale tax identification certificate. Once collected, we will not refund sales
taxes will not be refunded even if a valid number is subsequently provided.
4.
ALL
SALES ARE FINAL. NO REFUNDS.
5.
The auctioneer will call out each bid as he
receives it. We are not responsible for
any bid offered but not received. Buyer
must clearly signal his bids, listen to the bids called to be sure it was
received, and notify the Auctioneer immediately if his bid is called out
incorrectly. Any dispute among bidders
will be settled by the auctioneer at his sole discretion, and his decision and remedy
will be deemed final. Buyer must pay
for each item upon which his bid is accepted by the Auctioneer’s declaration to
the sale clerk.
6.
Purchases
must be removed from the premises on the day of the sale unless arrangements
are made with Auctioneer. Buyer
acknowledges that Auctioneer is not in any way responsible for protecting or
preserving any items belonging to Buyer and items left on the premises are at
his own risk.
7.
Auctioneer
is not responsible for any items lost, stolen or damaged. Ownership title passes upon the fall of the
Auctioneer’s gavel, and thereafter the property is at the risk of the buyer and
neither the seller, nor the auctioneer shall be responsible for loss or
damage.
8.
The
buyer hereby assumes and does agree to indemnify and hold harmless the
auctioneer and sellers from any current or future claim which shall pertain to
the fitness, use, damage, safety, injuries to persons or property that may have
occurred during the auction or that may have been caused by or during removal
or use of items purchased, or any other claim regarding the use of that asset
as purchased. The Auctioneer, Auction
Company, nor the Seller assumes responsibility for any accidents or loss due to
theft, fire, vandalism, or personal injury.
9.
10% Buyer’s Premium shall be
added to the top bid to become part of the purchase price.
10.
All
buyers must acknowledge and accept the terms and conditions provided at the
time of registration.
